Iceland supermarket chain resolves its trademark dispute with the nation of Iceland

The British frozen food retailer Iceland has concluded its 10-year trademark battle with the Nordic nation bearing the same name. After experiencing repeated defeats in court proceedings, the company’s leadership decided to discontinue further legal action and redirect resources elsewhere.

Executive chair Richard Walker announced the decision following the company’s third unsuccessful ruling. Rather than pursue additional appeals, he revealed plans to transform the disputed legal budget into shopping vouchers for Icelandic residents. The frozen food chain intends to distribute these incentives among customers in the country, effectively converting litigation costs into consumer benefits.

The Icelandic government initiated this prolonged legal dispute in 2016, asserting that the retailer’s exclusive European trademark registration prevented Icelandic businesses from effectively marketing their products internationally. The nation’s authorities maintained that geographical designations should remain accessible for public use rather than being monopolized by commercial entities.

The EU general court delivered its final judgment in July, confirming the cancellation of the supermarket’s EU trademark registration. The ruling reinforced that geographical names require public availability. Despite losing the dispute, Walker noted the company’s actual brand identity remains unaffected, though he expressed concerns about potential competitors now operating under identical names.

Walker assumed leadership of Iceland in 2023 following his father Malcolm’s retirement from the frozen foods enterprise he established in 1970. The Wales-based company operates more than 900 locations across the United Kingdom, functioning under both the Iceland and The Food Warehouse banners. The organization also manages Individual Restaurants, encompassing brands like Piccolino and Restaurant Bar & Grill.
